RESUMO:

The Brazilian National Politics on Solid waste, Federal law number 12.305came into effect in August 2010. Thus, from this time on there was a definition regarding municipalities' competenceson solid waste planning and integrated management. It also considered the participationof recyclable and reusable materials collectors involved in selective waste collection programs. The law seeksto promote economic emancipation and the social inclusion of individuals who have been historically excluded. In order to do so, the National Policy on Solid Waste indicates the need for the creation and hiring of self-management organizations (cooperatives and associations). These are perceived as models for social inclusion on behalf of waste pickers for the municipal selective waste programs. But, it is seen that this is not a major rule in the great majority of Brazilian cities. These organizations are formally responsible for local waste collection representing the social inclusion model for Brazilian legislators. The realities within these organizations vary but are supported by public power. There is need for further research that addresses issues such as the reasons these organizations shy away from the legally established policy goals. Thus, the research aims to acknowledge: Considering the relationship between waste collector organizations and public power, do these organizations have the same capacity to socially include these waste collectors? What factors contribute to distancing organizations from the reach of legal purposes?It is assumed that, issues such as the equal relationship between collector organizations and municipal public authorities, the effectiveness of the municipal selective collection program, the diversity of partnerships established by the organizations, the leadership exercised by representatives and the capacity of the organization contribute to the existence of distinct realities of inclusion. In this sense, the present research aims to study the social inclusion of recyclable material collectors regarding theestablished National Policy on Solid Waste model. In order to carry out the study, the research focuses on an approach that considers the discussion on labor activity carried out by the collectors and the presentation of the Brazilian social inclusion model of these individuals according to the guidelines present in Law number 12.305. Thus, it possible to comprehend the scenario by the analysis of the experiences drawn by the recyclable waste collector organizations in Brazil; serving as a basis for the proposed analysis. In order to acknowledge the internal reality if these organization indicators elaborated by The Brazilian National Health Fundation-Funasa were used. In 2016 these indicators were considered asabase to analyze the organization’s social inclusion capacity since they were set in order to support management and planning actions for the National Policy on Solid Waste guidelines.
