MONITORING LITIGATION AS A JUDICIAL INTELLIGENCE TOOL: DEVELOPMENT AND VALIDATION OF A STRATEGIC JUDICIAL GOVERNANCE PROCESS AT TRT21

Litigation constitutes a structural variable of the Brazilian justice system, posing ongoing challenges to courts in ensuring effective judicial protection within a reasonable time. In the Labor Justice system, the recurrence of repetitive claims, the concentration of litigants, and the increasing complexity of disputes highlight the need not only to enhance decision-making productivity but also to implement organizational mechanisms capable of monitoring and understanding the dynamics of the caseload. In this context, although national-level guidelines aimed at judicial intelligence and the systemic treatment of litigation are in place, the Regional Labor Court of the 21st Region (TRT21) lacks a formal, structured, and continuous organizational process for monitoring litigation. The main objective of this study is to develop a proposal for an institutional litigation monitoring process within TRT21, conceived as a tool for generating qualified information to support administrative and judicial decision-making. The specific objectives are: to identify the requirements necessary for structuring the process; to characterize the process in terms of scope, actors, inputs, outputs, rules, and controls; to model the process in its proposed state; and to validate the proposal with institutional actors holding decision-making authority. The research adopts a methodology consistent with a professional master’s program, focusing on the development of an applicable organizational intervention proposal. It employs an action research approach, combined with document analysis and institutional validation. As a result, the study presents a structured model for a litigation monitoring process, including the definition of workflows, responsibilities, and minimum governance mechanisms, capable of supporting its future institutionalization within TRT21.
