SUMMARY:

The present work aims to conduct a study on the uses of evidence and narratives in the processing of crimes related to drug trafficking in Rio Grande do Norte, focusing on the drug criminal (public) policy in Brazil. This policy is grounded in the National System of Public Policies on Drugs – Sisnad, established by Law No. 11,343/2006, which outlines a series of measures for preventing drug use and repressing drug trafficking (BRAZIL, 2006). Furthermore, it is executed by various actors—military police, civil police, police inspectors, prosecutors, judges, among others—who possess different (and sometimes similar) knowledge, techniques, beliefs, and practices regarding the implementation of this policy, and have “a significant decision-making space” (Muniz, 1999). Thus, evidence, narratives, and information appear as the basic input in this daily flow of relationships, people, and roles within the scope of criminal justice. In this regard, the main objective is to analyze how state actors, implementers of drug criminal policy, use evidence, narratives, and information in criminal proceedings and in their work routines, seeking to reflect on their spaces of discretion. To achieve this, a documentary analysis of drug trafficking cases in Rio Grande do Norte will be conducted, along with an ethnography involving actors responsible for implementing drug criminal policy who have experience with drug trafficking crimes. Therefore, conducting such a study involves reflecting on the procedures and epistemologies surrounding the discretionary spaces used by different actors who are interdependently related in the public criminal drug policy. Through this, the aim is to understand one aspect of the operational logic of the bureaucracy within the criminal justice system and drug criminal policy.
