SUMMARY:

The right to housing and the right to the city are basic human rights, essential for the guarantee of human dignity, and integrate part of the existential minimum. Decent housing and access to a sustainable city, however, are still goals to be achieved by the Brazilian State, a country marked by social chasms, which have historical roots and were aggravated by the rampant urbanization process that devastated the country since the middle of the last century. As a consequence of the uneven urbanization process, slums, tenements, spaces of poverty and self-construction of housing emerged. A possible way to address the issue of urban informality and urban exclusion is urban land regularization, a policy that aims to improve the population's quality of urban life, with the implementation of public services, infrastructure and land legalization. This, however, is just one point of view on this policy, which is conceived by some theorists and public agents only considering the aspect of land legalization. In this perspective, Law nº 13.465/17, which establishes the new framework for urban land regularization in the country and which was conceived in a context of political change in the country, remodels the vision of this public policy, making it lose its force as a policy that must be applied in an integrated manner, to a model that values land tenure legalization at the expense of improving urban quality. It is in the face of this issue that the current research seeks to understand the dynamics of urban land, especially in regards to the protection of the right to housing and the right to the city, in the urban land regularization policy, based on the experiences of REURB-S in the Community da África and in the Passo da Pátria Community, in Natal/RN, between the years 2015 and 2021. In the methodological aspect, a comparative study will be used, seeking similarities and differences between the REURB-S processes in Africa and in Passo da Pátria, in Natal/RN. Research techniques include bibliographic research, document analysis, direct observations and interviews with public agents and community leaders.
