SUMMARY:

Access to justice, understood as the concrete possibility of obtaining effective, adequate, and socially legitimate judicial protection, is a relevant topic for the protection of rights and for the improvement of public justice services. In this context, the contemporary functions of the court officer are addressed in light of the fourth wave of access to justice, with emphasis on professional ethics, the humanization of judicial diligences, the certification of self-composition proposals, and procedural intelligence. Thus, the research problem is expressed by the following question: to what extent can the resignification of the court officer’s duties, when accompanied by ethical, humanized, technically qualified action that is sensitive to social and digital vulnerabilities, contribute to the effectiveness of access to justice in its material dimension? The study is justified by the social and legal impact of this public agent’s work, since the court officer often represents the point of contact between judicial decisions and the concrete reality of court users, being able to improve procedural communication, reduce rework, encourage consensual solutions, qualify the information brought to the case records, and strengthen public trust in the Judiciary. The general objective is to examine the contribution of the court officer to the practical realization of access to justice within the context of the fourth wave. The specific objectives are to analyze the theoretical development of access to justice based on the waves of reform; investigate the fourth wave as a shift of focus toward the actors who operate within the justice system; examine the humanization of judicial diligences as a criterion for the quality of judicial service; assess the limits of certifying self-composition proposals and procedural intelligence; and propose guidelines for a humanized, intelligent, and self-compositive performance. As methodological procedures, the study adopts theoretical research, with a qualitative approach, exploratory-descriptive purpose, basic nature, and bibliographical-documentary procedure, through the analysis of legal scholarship, legislation, normative acts issued by the National Council of Justice, institutional data, and studies concerning the position. It concludes that the court officer should not be understood as a merely mechanical executor of judicial writs, but as an agent of procedural concretization, whose performance may contribute to judicial effectiveness, provided that functional limits, institutional safety, continuing education, and responsible use of information and systems are observed.
