SUMMARY:

The crisis of the Brazilian prison system, marked by overcrowding, ineffective social reintegration, and recurring human rights violations, was acknowledged by the Federal Supreme Court as an Unconstitutional State of Affairs in ADPF no. 347. In this context of institutional collapse, this dissertation analyzes the methodology of the Association for the Protection and Assistance to Convicts (APAC) as a humane and viable penal alternative, focusing on the challenges and possibilities of its implementation as a public policy in the state of Rio Grande do Norte (RN), based on the consolidated experience of Minas Gerais. The central research problem seeks to identify the institutional, political, legal, and social obstacles faced in RN, and to examine how the successful elements of the Minas Gerais model could be adapted. The study is justified by the urgent need to reformulate Brazilian penal policies, offering alternatives that respect human dignity and enhance institutional efficiency. A qualitative approach is adopted, guided by the deductive method and the case study technique, focusing on the APAC units in Macau and Macaíba. Data collection includes documentary analysis and institutional statistics. The theoretical framework is Luigi Ferrajoli's penal guaranteeism, which emphasizes the primacy of fundamental rights in limiting state punitive power. The results reveal barriers such as lack of intersectoral coordination and cultural resistance, while proposing strategic guidelines for consolidating the model in RN. The research concludes that the APAC methodology, by combining resocialization, community participation, and cost-efficiency, offers a concrete alternative to address the structural distortions of the current prison system and promote a penal execution aligned with the principles of a Democratic Rule of Law.
