SUMMARY:

This dissertation aims to analyze how quilombola communities in the states of Rio Grande do Norte and Ceará perceive, organize, and resist human rights violations in their territories. To achieve this purpose, qualitative, ethnographic, and comparative research is being conducted, using participant observation techniques and interviews, as well as bibliographic studies and documentary analyses. The results point out that the colonization process led to the commercialization and enslavement of black people, as well as the use of enslaved labor as a means of production. In Brazil, this process lasted for almost four hundred years and resulted in deaths, family separations, torture, and loss of culture and identity for the enslaved people. Therefore, it concludes that this oppression began during the colonial period and gained new contours in the republican period. In both scenarios, it is important to highlight the resistance of the black population, which, among other tactics, organized into quilombos to ensure their existence. With the Federal Constitution of 1988, the right to culture, identity, and territory of these communities became protected by law, and the quilombola movement strengthened its claims for these rights. However, while the state recognizes these rights, it also conditions their implementation to the recognition of communities as quilombolas. As a result, communities do not enjoy the same legal status in the face of public administration, a condition that affects the greater or lesser direction of public policies toward these groups.
