SUMMARY:

This dissertation investigates the occurrence of potential regulatory gaps in the wind energy sector in Rio Grande do Norte, specifically related to energy efficiency, with an emphasis on analyzing data from the sector's expansion over the past ten years. In Rio Grande do Norte, the proliferation of wind energy projects occurs alongside structural challenges that undermine the equitable distribution of the benefits generated. The following problematization is posed: do regulatory gaps in the wind energy sector impact energy efficiency in the state of Rio Grande do Norte? It is evident, in advance, the scarcity of legal approaches that correlate the socioeconomic and environmental effects of wind energy activities with the current legal framework, particularly in light of Sustainable Development Goals (SDGs) 7 and 10 of the United Nations 2030 Agenda. Likewise, it is conceivable that the regulatory gap affects the sector's performance and its impact on society. The objective is to identify whether the regulatory gaps in the wind sector of Rio Grande do Norte have an effect on energy efficiency. The research is applied in nature, with a theoretical focus, and adopts a deductive method, moving from general normative analyses to the specificities of the wind sector in Rio Grande do Norte, using a qualitative-quantitative approach that combines conceptual analysis and empirical data. The results show a significant disparity between the economic growth of the sector and the concrete effects on local communities, characterized by normative asymmetries, a lack of effective social compensation mechanisms, and gaps in oversight and transparency regarding corporate obligations. In this context, it is essential to improve regulations that ensure, equitably, a legislative adjustment so that energy efficiency can be achieved, while respecting the rights of affected populations and promoting sustainable development, with a view to fostering a better balance between economic growth and socio-environmental justice.
