SUMMARY:

The present study, entitled "Liability of marketplace platforms regarding the protection of consumers' personal data", addresses the consumer relations developed through e-commerce. One can see that marketplace platforms have been gaining space in recent years, because consumers are increasingly focused on the practicality of acquiring products and services without having to leave home; however, in view of this growth, one must know the laws that guide these practices and ensure that consumers have their personal data protected. For the development of this research, we started from the following problem: what is the liability of marketplace companies for the leakage of consumers' personal data? A study of this kind is justified by the need to take an analytical look at the theme, fostering debate on the importance of knowing the nuances of commercial interactions and the protective elements about how consumer information is handled by the responsible agents on the platforms. The general objective is to analyze the General Law of Protection of Personal Data and how it seeks to safeguard the information of users of Marketplace platforms. About the specific objectives, one can list: to conceptualize E-commerce and Marketplace; to verify the consumer relations developed in virtual commerce platforms; to discuss the nuances of the LGPD; to discuss about the responsibilities (Civil, Criminal and Administrative). From a methodological point of view, it employs a research with bibliographical and legislative procedure, of applied nature, with descriptive objective, qualitative approach and hypothetical-deductive method. Therefore, it is concluded that consumer relations established in virtual spaces must respect the norms provided for in the LGPD, and that anyone who does not act appropriately in the treatment of consumers' personal data will respond from the Law; thus, it is necessary that those responsible for these platforms seek to adapt to the legislative requirements, notably so that they will not be held liable civilly, administratively and criminally.
