SOLID WASTE MANAGEMENT AND REVERSE LOGISTICS AS EFFECTIVENESS OF THE POLLUTER PAYS PRINCIPLE

This work gathers information about the polluter pays principle, investigating how it can be effectively assumed by public management, and by the community as a whole, based on the national solid waste policies (PNRS) contemplated by Law nº 12.305/10, which instructs how the country should take care of the garbage, so that environmental pollution is avoided. It is approached about the jurisprudence with regard to the ecologically balanced environment, in order to make a connection with the polluter pays principle, which coercively helps to guarantee this fundamental right. The study establishes criteria for the allocation of environmental costs and analyzes some instruments for applying this principle; such as reverse logistics practices, in addition to the PNRS. It also analyzes special situations in which the immediate application of very restrictive regulations could cause serious economic disturbances, for which in these cases, it is concluded by recommending grading and assistance, submitting any study related to the deepening of the matter in question an examination of the gaps in the principle, especially with regard to activities whose application demands extreme consequences.
